These Terms of Service ("Terms") govern your use of the Chicken Road mobile application (the "App"), website, and any related services (collectively, the "Services") provided by Chicken Road ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account or using the Services, you affirm that you are at least 13 years old (or the minimum age required in your jurisdiction to use such services without parental consent) and agree to these Terms. If you are under the age of 18, you represent that your legal guardian has reviewed and agreed to these Terms. This is a crucial step in our "Chicken Road" journey together; ensuring all travelers understand the rules of the road, so to speak. Our unique "Chicken Road" approach to navigation means we value clear understanding and agreement from all our users.

2. The Chicken Road Service

Chicken Road provides a platform for discovering and navigating routes, finding points of interest, and sharing experiences. While we strive to provide accurate and entertaining information, you acknowledge that all routes, suggestions, and information are provided "as is" and for entertainment and informational purposes. You are solely responsible for your safety and decisions while using our Services. Always obey traffic laws, be aware of your surroundings, and exercise common sense. The "Chicken Road" may sometimes lead to unexpected places, and while that's part of the fun, safety is paramount. Remember, every "Chicken Road" is an adventure, but responsible adventuring is key.

No Guarantees: We do not guarantee that you will find actual chickens, perfectly cooked chicken, or that all "Chicken Roads" will be free of actual road chickens. Some roads may be metaphorical. Enjoy the whimsy, but travel responsibly. The spirit of the "Chicken Road" is about discovery and joy, not literal poultry at every turn, though we won't complain if you find some!

3. User Accounts

To access certain features of the Chicken Road, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, untrue, or incomplete, or if you violate these Terms. Your account is your passport to the many "Chicken Roads" we offer, so keep it safe.

4. User Conduct and Content

You agree not to use the Services to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable on any "Chicken Road" or associated platform.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity while navigating a "Chicken Road."
• Upload, post, or transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.
• Violate any applicable local, state, national, or international law.
• Interfere with or disrupt the Services or servers or networks connected to the Services, thereby obstructing others' "Chicken Road" experiences.

If you contribute content, such as custom "Chicken Roads" or reviews ("User Content"), you grant Chicken Road a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services and Chicken Road's (and its successors' and affiliates') business. You represent and warrant that you have all necessary rights to grant us this license for all your "Chicken Road" contributions.

5. Intellectual Property

The Services and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content belonging to other Users (the "Chicken Road Content"), and all Intellectual Property Rights related thereto, are the exclusive property of Chicken Road and its licensors (except for your User Content). Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights for the "Chicken Road" brand or its assets.

6. Subscription Services and Payment

Certain features of the Services, such as premium "Chicken Road" maps or ad-free experiences, may be offered on a subscription basis ("Subscription Services"). If you choose to purchase Subscription Services, you agree to pay the applicable fees. All fees are non-refundable except as required by law or as otherwise stated by us. We may change the fees for Subscription Services at any time, but changes will not apply retroactively. Subscriptions may auto-renew unless canceled, ensuring your continued access to exclusive "Chicken Road" features.

7. Disclaimers and Limitation of Liability

THE "CHICKEN ROAD" SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." CHICKEN ROAD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. NAVIGATING ANY "CHICKEN ROAD" IS AT YOUR OWN DISCRETION.

TO THE FULLEST EXTENT PERMITTED BY LAW, CHICKEN ROAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE "CHICKEN ROAD" SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. THE "CHICKEN ROAD" IS A JOURNEY OF FUN, BUT WE CANNOT BE LIABLE FOR ALL OUTCOMES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE "CHICKEN ROAD" SERVICES SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNTS PAID BY YOU TO CHICKEN ROAD FOR THE PAST THREE MONTHS OF THE SERVICES IN QUESTION.

8. Indemnification

You agree to defend, indemnify, and hold harmless Chicken Road and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the "Chicken Road" Services or your violation of these Terms. This means if your actions on a "Chicken Road" cause issues, you're responsible.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the "Chicken Road" Services shall be resolved exclusively in the state or federal courts located in Delaware. This is the legal "Chicken Road" all disputes must follow.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice, such as by posting the updated Terms on our website or notifying you through the App. Your continued use of the Services, including any "Chicken Road" feature, after any such changes constitutes your acceptance of the new Terms. We encourage you to periodically review the Terms to ensure you understand the terms and conditions that apply to your use of the "Chicken Road."
